一、來(lái)華就業(yè)外國(guó)人如何分類?

How to classify foreigners who work in China?

1.外國(guó)高端人才A類:中國(guó)經(jīng)濟(jì)社會(huì)發(fā)展急需的科學(xué)家、科技領(lǐng)軍人才、國(guó)際企業(yè)家、專門(mén)特殊人才等“高精尖缺”外國(guó)高端人才,符合國(guó)家引進(jìn)外國(guó)人才重點(diǎn)和目錄條件人員。包括入選國(guó)內(nèi)人才引進(jìn)計(jì)劃;符合國(guó)際公 認(rèn)的專業(yè)成就認(rèn)定標(biāo)準(zhǔn)的;創(chuàng)新創(chuàng)業(yè)人才;優(yōu)秀青年人才。

Class A high-end foreign talents: "top and high-end talents" such as scientists, science and technology champions, international entrepreneurs, and special talents urgently needed for China's economic and social development, and personnel who meet the criteria of key points and catalogs for the state's recruitment of foreign talents, including talents admitted to the domestic talent recruitment plans of China, talents in conformity with internationally recognized standards of professional achievement, innovative and entrepreneurial talents; and excellent young talents.

2.外國(guó)高端人才B類:符合外國(guó)人來(lái)華工作指導(dǎo)目錄和崗位需求,屬于中國(guó)經(jīng)濟(jì)社會(huì)事業(yè)發(fā)展急需的外國(guó)專業(yè)人才。包括具有學(xué)士及以上學(xué)位和2 年及以上相關(guān)工作經(jīng)歷的外國(guó)專業(yè)人才;持有國(guó)際通用職業(yè)技能資格證書(shū)或急需緊缺的技能型人才;外國(guó)語(yǔ)言教學(xué)人員;符合國(guó)家有關(guān)部門(mén)規(guī)定的專門(mén)人員和實(shí)施項(xiàng)目的人員。

Class B high-end foreign talents: foreign professionals who meet the requirements of the guidance catalogs and positions for foreigners to work in China and are urgently needed for China's economic and social development, including foreign professionals with a bachelor's degree or above and 2 years or more related work experience, skilled talents holding international general vocational skill qualification certificates or urgently needed; foreign Language teachers, and special personnel and personnel implementing the projects in conformity with the regulations of relevant authorities of the state.

3.其他外國(guó)人員C類:滿足國(guó)內(nèi)勞動(dòng)力市場(chǎng)需求,符合國(guó)家政策規(guī)定的其他外國(guó)人員。包括符合現(xiàn)行外國(guó)人在中國(guó)工作管理規(guī)定的外國(guó)人員;從事臨時(shí)性、短期性(不超過(guò)90日)工作的外國(guó)人員;實(shí)施配額制管理的人員。

Class C other foreigners: Other foreigners who meet the needs of China's domestic labor market and comply with China's national policies, including foreigners who meet the current regulations on the administration of work of foreigners in China, foreigners engaged in temporary and short-term (no longer than 90 days) work; and foreigners subject to quota system management.


二、短期來(lái)華工作的外國(guó)人員如何界定?

How to define short-term foreign workers?

因下列事由入境且在境內(nèi)停留不超過(guò)90日的,應(yīng)申辦C類外國(guó)人來(lái)華工作許可:

Foreigners who enter China for the following reasons and stay in China for no more than 90 days should apply for Class C Foreigner's Work Permits:

1.到境內(nèi)合作方完成某項(xiàng)技術(shù)、科技、管理、指導(dǎo)等工作;

Certain technical, technological, management and guidance work with partners in China;

2.到境內(nèi)體育機(jī)構(gòu)進(jìn)行試訓(xùn)(包括教練員、運(yùn)動(dòng)員);

Trial training at sports institutions in China (including coaches and athletes);

3.拍攝影片(包括廣告片、紀(jì)錄片);

Film shooting (including advertising films and documentaries);

4.時(shí)裝表演(包括車(chē)模、拍攝平面廣告等);

Fashion performances (including car show girls/boys and print advertisements);

5.從事涉外營(yíng)業(yè)性演出;

Foreign-related business performances;

6.人力資源社會(huì)保障部認(rèn)定的其他情形。

Other circumstances recognized by the Ministry of Human Resources and Social Security of the People's Republic of China.


三、配額管理人員中根據(jù)政府間協(xié)議來(lái)華實(shí)習(xí)的外籍青年是哪些?

Among foreigners subject to quota management, who are young foreigners coming to China for internships according to the intergovernmental agreement?

來(lái)華實(shí)習(xí)政府間協(xié)議,是我國(guó)政府與相關(guān)國(guó)家政府聯(lián)合開(kāi)展的推動(dòng)青年跨國(guó)實(shí)習(xí)交流的雙邊合作項(xiàng)目。計(jì)劃旨在幫助協(xié)議國(guó)雙方未就業(yè)青年開(kāi)拓國(guó)際視野,提升職場(chǎng)能力。 2016年以來(lái),我國(guó)先后與法國(guó)、德國(guó)簽訂了雙邊合 作項(xiàng)目協(xié)議。目前,法國(guó)和德國(guó)青年可以通過(guò)參與實(shí)習(xí)項(xiàng)目的方式,申請(qǐng)來(lái)華工作許可,項(xiàng)目配額為每年 1000人。項(xiàng)目具體內(nèi)容及用人單位條件可登錄中國(guó)國(guó)家人才網(wǎng)查詢青年國(guó)際實(shí)習(xí)交流計(jì)劃獲取。

The inter-governmental agreement on internships in China is a bilateral cooperation project jointly carried out by the Chinese government and the governments of relevant countries to promote transnational internships and exchanges among young people. The plan aims to help the unemployed young people in the countries in the agreement to broaden their international horizons and improve their professional skills. Since 2016, China has signed bilateral cooperation project agreements with France and Germany. Currently, French and German young people can apply for work permits in China by participating in internship projects, with a quota of 1,000 people per year. 四、 符合規(guī)定條件的外國(guó)留學(xué)生和境外高校外籍畢業(yè)生配額制管理有什么要求?

What are the quota system management requirements for foreign students and overseas foreign university graduates who meet the specified criteria?

人社部、外交部、教育部2017年聯(lián)合下發(fā)通知,就允許優(yōu)秀外籍高校畢業(yè)生在華就業(yè)有關(guān)事項(xiàng)進(jìn)行了明確。其中人員范圍規(guī)定為:在中國(guó)境內(nèi)高校取得碩士及以上學(xué)位且畢業(yè)一年內(nèi)的外國(guó)留學(xué)生,以及在境外知名高校取得碩士及以上學(xué)位且畢業(yè)一年以內(nèi)的外籍畢業(yè)生。

In 2017, the Ministry of Human Resources and Social Security of the People's Republic of China, the Ministry of Foreign Affairs of the People's Republic of China, and the Ministry of Education of the People's Republic of China jointly issued a circular on matters concerning the employment of outstanding foreign university graduates in China. The scope includes foreign students who have obtained a master's degree or above in universities in China and graduated within one year and foreign graduates who have obtained a master's degree or above in well-known overseas universities and graduated within one year.

外國(guó)留學(xué)生工作許可首簽有效期為1年,如外籍人員在聘用期間所繳納的個(gè)人所得稅低于意向薪酬應(yīng)付稅額、或用人單位擬給予其的薪酬低于規(guī)定標(biāo)準(zhǔn)的,工作許可不予延期。

The validity period of the work permits for foreign students is 1 year and the work permit is not extended if the personal income taxes paid by a foreigner during the employment period are lower than the tax payable on the intended remuneration, or the remuneration to be paid by the employer is lower than the prescribed standard.
